The Secretary noted that, contrary to expectations, Judge Stecher of the Supreme Court of New York has not yet approved the transfer of Heye Foundation collections and other properties to the Smithsonian. In discussion, the Secretary outlined the process which was followed in developing the proposed slate of appointees to the Board of Trustees of the National Museum of the American Indian. In accordance with the enabling legislation, fifteen candidates had been selected by the Heye Foundation Board of Trustees from among its membership and eight others were nominated by the Secretary. Although other persons could be nominated by the Regents, no additional nominees were suggested.

The following motions were suggested and approved:

VOTED that at such time as rulings consistent with the Memorandum of Understanding between the Smithsonian Institution and the Museum of the American Indian, Heye Foundation, agreed to May 8, 1989, are rendered by the courts of New York and all other conditions therein are fulfilled, the Board of Regents agrees to accept from the Museum of the American Indian, Heye Foundation, its entire collection of books, objects, and works of art; its endowment; and all other property, excluding the exhibition facility at 3753 Broadway, New York, New York, for the purpose of the National Museum of the American Indian authorized by Public Law 101-185, enacted November 28, 1989;

VOTED that in accordance with Article Fourth (A) of the Memorandum of Understanding between the Smithsonian Institution and the Museum of the American Indian, Heye Foundation, agreed to May 8, 1989, and Section 5(e) of Public Law 101-185, the Board of Trustees of the National Museum of the American Indian is hereby constituted and to it are named the following persons, each to serve a term of three years from the date of acceptance by the Board of Regents of the collection of books, objects, and works of art; the endowment; and all other property of the Museum of the American Indian, Heye Foundation:
