(Col d) [[underlined]] Thomas Bond - [[/underlined]] Examined ^[[insertion]] by the Court [[/insertion]] as to his capacity as a witness- Knows the obligation of an oath- punished for breaking it- sent to Penitentiary and go to hell- Believes in Heaven and Hell- no one who committed perjury can go to Heaven- Admitted.

Is brother of prisoner- Knows where he was arrested. Saw him several times on Monday before, at 9, at 2, 7 P.M. from thence till 12 midnight. He was at witness' house, they were singing. Went to bed at 12 Pris. did also- Morning, he was there- Witness lives at Fort Baker, 200 yards from main road from Washn to Oldfield. Tuesday, the prisoner mounted his horse; it was snowing, & a very stormy day- The horse he mounted was one he owned for more than a year, a [[underlined]] large [[/underlined]] bay horse- He rode away & in about two or three hours, he rode back; it was about 2 P.M. on another horse, a smaller bay- He  put him in the stable, where he had kept the other horse,
