upon the stand by me, and his answer not accounted for: that Bond had admitted to Arnold, that no one was present when the trade was made & that Foster & Randolph had not testified to the truth, the most charitable view taken by them was, that they were mistaken. I prepared a motion for new trial, & submitted affidavits of Jared & Mary McKenna, that Bond was in their store on Monday, purchased & paid for a stove about 12 of 1 oclock.
