SMITHSONIAN INSTITUTION  1241

RESOLVED: That the Board of Regents of the Smithsonian Institution hereby approves the recommendation of the Smithsonian Art Commission that Messrs. John Taylor Arms, Gifford Beal, and Gilmore D. Clarke be re-elected members of the Commission to succeed themselves.

On motion, the resolutions were adopted.

THE GELLATLY ART COLLECTION

The Secretary made the following statement:

At the annual meeting last year it was reported that there had been a hearing in the Court of Claims relative to Mrs. Gellatly's demands for $10,000 as part value of the collection, and that the Institution is defended in this proceeding by the Department of Justice through Mr. Grover Sherrod. The Institution has in addition the assistance of Mr. Huntington Cairns, General Counsel for the National Gallery of Art.

The case has now proceeded to the point where proof is closed, and the Commissioner has made findings which, it may be observed, on their face appear favorable to the Smithsonian. The plaintiff took no exceptions but the Institution filed several. The plaintiff has filed a brief and that of the Institution is to be filed January 17. Thereafter the case will come up for argument before the Court of Claims, probably during the spring.
