3rd Immediately after Court and before the Writ of Appraisement was issued and the articles appraised as required by law, I received from Captain M.J. Manning Agent Bureau R. F. & A. L. the order herewith filed marked (exhibit A) which is asked to be made part of this answer.

Being estopped by said Order I took no further steps in the case, though by so doing a hardship has been inflicted upon some of the creditors, and more especially Mrs. Mary Lunsford, whose family is today in want, and who is in need of the money she expended on Mr. Marshall, during his last illness.

As to Francis Hopson, her claim is founded on the Nuncupative Will alone, and has no other claim to the estate of J. W. Marshall, I will here state to your Honor that she can yet have the will if she desires to.

That your Honor may not think that I have been dilatory in my action I will here say that I thought it my duty to obey the orders from the Head Quarters of the District any order issued in pursuance thereof, though by what train of reasoning
