100 Hdqrs Asst. Comm. N.C. Raleigh N.C. feb 15th 1867 Circular No. 4 Instructions in congruence of the above Circ. no. 3. ____ Hdqrs. A. C. St. N.C. Raleigh N.C. feb 16 1867 Circular no. 5 I The Supreme Court of N.C having recently decided in the case of "Ambrose v. Russel" that wherever the County Courts have bound out children, white or colored, as apprentices without previous notice to the parents or next of kin of such children, and wherever the children were not present in Court at the time of binding, the indentures are illegal and void. This decision, it is believed, will operate to annul all cases of apprenticeship in the State, where children have been bound out, against the will of their parents, and in future protect the free people from injustice and oppression in this respect. II Officers and Agents of this bureau will at once take the necessary measures to secure the cancellation of all indentures thus decided to be illegal, at the next ensuing term of the C. Courts of their resp. districts, and to aid the children in returning to their parents or legal guardians. III It will be required of Officers & Agts to attend at every term of the C. Courts in their resp. districts, to counsel, aid and assist the free people in obtaining their rights. IV A monthly report will be required of each Off & Agt. giving the time and place of the setting of the Courts in their resp. districts, with name and residence of the presiding Judge and Solicitor, with the number of indentures of apprenticeship of all children made and cancelled by said courts. Washington feb 20/67 Circular no 5 For the more complete organization of schools for R & F. it is ordered that the Sub Asst. Commiss & Agents of this bureau in each subdistrict will in connection with their other duties visit the schools now in operation in their [[?]] fields, inducing teachers to report promptly on the [[?]] furnished by the Sr. Supt. of schools for this [[?]]. They will also observe the various plans on which these schools are conducted suggesting improvements or noting defects. They will gather information as to places ran destitute of schools the number of youth & children therein between the ages of 6 & 21 years, the encouragements and the obstacles existing to new schools being opened if means are furnished. They will also ascertain what more can be done for the im-provement in knowledge of the adult freedmen - all of which will be reported the Asst. Commis. for the State Supt of schools. Care should be taken by the officers & agents of the Bureau in the performance of the above duties not to interfere with the [[?]] of the local Supts or the Teachers of the several Educat. Assoc but it is essential that both work together but it is essential that both work together in mutual consultation & sympathy.
