with the witnesses (Diana & Benjamin Fitzgerald) together with all the others in the case to Genl. Pennypacker Comdg. Post at Grenada Miss on Sept. 12th '67. I telegraphed to Asst. Comr State of Miss. under date of Sept. 11th 67 requesting instructions, which were sent by letter under date of Sept. 12th and received and answered by me (with special report sent) Sept 14th. I telegraphed for a guard of freed men Sept 11 '67 which were promptly sent and reported to me at daylight Sept 12th '67, one witness for prosecution is still absent his name is Wilson Fitzgerald (col'd) who lives 6 miles north east of Hernando Miss on the plantation of Mrs. Stokes. I believe the trial of the prisoner will prove this to be a cold blooded and malicious murder. I hope the Asst. Comr. will approve of my actions in the case.
