corn, cotton, Potatoes, &c. The parties of the Second part agree to cultivate the Said farm, gather the crop of Corn, [[strikethrough]] fodder [[/strikethrough]] fodder, peas, potatoes, Cotton, and anything else agreed to And Retain one half to themselves except the corn, - a third retained only and deliver the other part to Said Swearingen (except the wheat now soon take Swearingens, they sow herafter).
And it is further Agreed that should the said Swearingen fail neglect or refuse to fulfil any of the obligation assumed by him, he shall besides the legal Recourse left to the party of aggrieved render this Contract liable to annulment by the [[crossed-out]] Provost Marshal of [[/crossed-out]] Commissioner of Freedmen & Freedwomen.
And it is also Agreed that should the party of the Second part fail neglect or refuse to comply with the terms of this Contract on thar part and the fact shall be proven to the Satisfaction of the proper officer. The party so offending shall be punished in such manner as the [[crossed-out]] Provost Marshal [[/crossed-out]] Sub Commissioner of Freedmen shall deem proper.
