Know all men by these presents That whereas John Rogers, late of the City of Fort Smith in the County of Sebastian, in the State of Arkansas departed this life a widower, or or about the 9th day of October AD 1860 leaving a last will and testament and therein and thereby appointed Wm. H. Rogers his son, and John Stryker executors thereof which said will was duly probated and of record as such in said County; And whereas in and by said will the said testator bequeathed and devised all and singular his estate, subject to his lawful debts only - to his children and heirs at law. namely; Wm. H. Rogers, Hickory Rogers, John T. Rogers, Woods B. Rogers, Margaret H. Melvin, wife of John Melvin, since divorced and now sole and unmarried and Emma C. wife of James A. Johnston;

And whereas: the said Hickory and John T. Rogers have transferred all their undivided interest in said Estate to the said William H. Rogers and the said Woods B. Rogers has assigned conditionally all his undivided interest in said Estate to John B. Latham of said City, and the said Woods B. Rogers and the said James A. Johnston have constituted and appointed the said John Stryker their attorney in fact to sell and convey their undivided interests in said Estate.

And whereas the said several Deeds of assignment and powers of attorney are of record
