he can prove by Simpson Dears that George Minor said he would get his (Smiths) Bond for the horse and then trade it to a negro so as to collect it though this Bureau - Simpson Dears lives near Oxford and will not attend without summons from you. 

By Enoch Allen he will prove that John Harris told him that the horse in question belonged to George Minor.

I respectfully apply for leave to file the affidavit of Simpson Dears, or [[strikethrough]] postpone the decision until next we can get a [[/strikethrough]] for an order Subpoena to be served on him, through the Sheriff -

I send Mr Smith with this the application is for an order to Simpson Dears, to appear and testify when you may be pleased to appoint. Mr Smith will see that it is executed forthwith.

The affidavit of Mr Jenkins is not as full as it might be but it substantiates the appeal made to Head Quarters on behalf of Mr Smith and shows that the Bureau has not the jurisdiction
