During the month of March last Judge McFurson in order to work his land more effectualy applied to me for the purchase of a horse, for a long time I was unwilling to grant his request, finally yealded by his paying one half in cash the balance in work six days per week. The said McFurson had in his hands and under his controle the horse about three weeks. failing to comply with the contract I ordered the horse to be returned. which was done, the horse being in a starved condition so weak that he was unable to stand any length of time. finally became to feeble that my entire force of men were unable to raise him. I had to kill him to put him out of misery. McFurson failed to do any work for me in payment, as of agreement.

Batcheller this summer: know Judge McPherson: he got a horse from Capt Batcheller; I had used the horse up to this time The horse was in working order. McPherson kept the horse about 10 days he kept him until he was nearly starved: the next morning after McPherson brought the horse back we had to lift him up, and finally had to kill him to keep him out of misery -- McPherson did not do any any work for Mr. Batcheller, as he agreed to as payment for the horse
