Lewis White, Freedman. I have worked for Mr H.N. Batcheller this summer. I know Judge McPherson. He got a horse from Capt. Batcheller: kept him about ten days. McPherson then brought the horse back - When the horse was delivered to McPherson he was in good condition. I had spoke for the horse myself but Capt Batcheller said he had engaged with McPherson. I wanted the horse at the same price When he was returned - I saw him -  he was in very bad condition - The next morning we had to go into the stable and brace him up - we kept him in this position, until he fell down two or three times - and finally killed him to get him out of misery. The Horse Doctor didn't do him any good. Judge McPherson did not do any work after he got the horse from Mr. Batcheller. 
I wanted the horse of Mr. Batcheller, he was a fine horse - but as the Captain had engaged him to McPherson I could not get him. Mr. Batcheller said that he had agreed to let McPherson have the horse, if he didn't take him I could have him at the same day.
