I have been at work for Capt. H.N. Batcheller this year. I know Judge Mc Pherson - He got a horse from Captain  Batcheller. The horse was returned to Capt. Batcheller. The Judge brought him the horse was starved. We had to lift him up and help him - he ate his bedding. The horse couldn't stand up without being braced up. Three days after he was brought back we had to kill him. We had to kill him, because we wanted to get him out of misery- This was after we had worked three days on him.

I have been at work for Capt. H.N. Batcheller this year. I know Judge Mc Pherson. He got a horse from Capt. Batcheller- carried home, and after keeping him 8 or 10 days he brought  him back. The horse was in an awful fix when he was brought; the horse could not stand up in the evening - he fell sometime in the night, from weakness. I help to brace him up, and after three days of bolstering we killed him to get him out of misery. My opinion is that it was nothing but starvation that caused the horse to be in the condition he was. He was very poor and completely worked down. He was in fair condition and could do a days work when Capt. Batcheller let Mc Pherson have him.
