The undersigned begs leave respectfully to ask a new hearing in the matter of himself against Jordan White, decided by you Ap'l 24th 1868.

The reasons for this request are as follows:

First; The claim of Jordan White that 22 cords of two-foot wood was cut by him before the ratification of the written contract between us is unfounded.  The wood was cut & delivered in three parcels, eleven & 1/2 cords before the writing and twenty six cords and twelve cords after the writing — the twelve cords being delivered after the twenty six cords, and, therefore, by his own admission, after the writings were entered into.

Secondly; the written contract differed in no respect from the verbal contract, but the original bargain was reduced to writing to prevent further misunderstanding.

Thirdly; the custom of the neighborhood, in the judgment of the undersigned, respectfully tendered, can have no influence whatever [[crossed out]] on [[/crossed out]] on a contract freely entered into by both parties; and further the said Jordan White
