Sir (the Office of Sheriff of Cleveland Co N,C.)
A statement made by Andrew Eaves of 
Cleaveland Co N.C. dated May 12"1868 has been referred to this office by Bt Col UB Royal Comdg Port of Morganton NC for investigation and report ~ in which the said Eaves makes the following charges  Viz
"That D H Peeler, Peter Peeler, Benjamin, Newton, Joel Hoyle, W.A. Warlick and William Parker did maliciously throw him out of his house on the 23rd day of March 1868, thereby leaving him without shelter, and that the paid DH Peeler did intimidate and tried to discourage him from going to the election and from voting, 
That the said William Parker did rent him
the place from which he was thrown for three years and but two years of the time had expired where he was thrown out. The said Eaves further says that the said Benjamine Newton did maliciously threaten him

with violence."
This is therefore to inform you in compliance with the order of Bt Col. WB Royall Comdg Post at Morganton N,C. this case will be investigated at this office in Lincolnton in Friday June 5th 1868 at 11 o'clock a.m at which time you are requested to be present with such evidence as you may wish
to offer. No written evidence will be received unless the same is sworn & subscribed to before an Acting Justice of the Peace or other competent officer. And only then for good and sufficient cause, which must be stated therein, why the person or persons were unable to be present at the investigation.

I inclose herewith a notice to each of the following persons of Cleaveland Co N.C Viz
D.H. Peeler Peter Peeler, Benjamine Newton Joel Hoyle W.A. Warlick William Parker and Andrew Eaves of an investigation that will take place at this office in Friday June 5th 1868 at 11 o'clock am in compliance with an order of Bt. Col W B Royall Comdg Post at Morganton, and request that you cause said notices to be delivered to the persons stated above and inform this office of your action
