Your letter of the 8" inst to Lt. L.V. Caziarc A.D.C. has been referred to this Office by the Commanding Officer of the Post of Morganton N.C. in which you state that your wife & family have been annoyed and alarmed by a freedman discharging his pistol about your premises & behaving insoberly, and that you are anxious to have an example made of this case, for the future protection of your family and that the name of the freedman complained of is Ephraim Johnston. In reply to your letter I inclose herewith a copy of a letter I have addressed to Ephraim Johnston at Wood Lawn P.O Gaston Co. N.C. And if you find that it has no effect in causing Johnston to conduct himself in a proper manner, and wish to have him tried by a Military Commission, it will be necessary to make out charges & specifications. Showing how Johnston violated Par XII of General Orders No 10 1867, supported by sworn statements of the persons who saw Johnson carrying a deadly weapon.

and forward the same to the Commanding Officer Mil. Post of Morganton N.C. I trust the letter I have written to Johnston, will be a sufficient warning to him, and relief to you of the necessity of attending a trial with your witnesses at Morganton N.C

A letter has been referred to this Office from General Canby; Head Quarters, written by Mr. Jo. Graham, in which he states that his wife and family were much annoyed and alarmed by you discharging your pistol about his premises, and behaving unsoberly. I therefore write to inform you that you will get yourself into difficulty, and be severely punished if you violate the Military Orders, which state "The practice of carrying deadly weapons except by Officers & Soldiers in the Military service of the United States is prohibited. The concealment of such weapons on the person will be deemed an aggravation of the offence. A violation of this order will render the offender amenable to trial
