Defendant.

Plaintiff, by Lubelle and Bermann, her attorneys, complaining of the defendant, alleges:

FIRST: That plaintiff now is, and at all times hereinafter mentioned was, a resident of the City of Rochester, Monroe County, New York.

SECOND:  Upon information and belief, that defendant now is, and at all times hereinafter mentioned was, a corporation duly organized and existing under and by virtue of the laws of the State of New York, having its office and principal place of business in the City, County and State of New York.

THIRD:  That defendant now is, and at all times hereinafter mentioned was, engaged in the business of exhibiting and selling works of art and paintings to the public, and has facilities for the storage of works of art and paintings.

FOUR:  That heretofore and prior to the 4th day of March, 1948, the defendant agreed to store for plaintiff in a warehouse in the City of New York thirty-eight (38) paintings belonging to the plaintiff.

FIFTH:  Upon information and belief, that on or about the 4th day of March, 1948, a fire occurred in said warehouse of the defendant and all of said thirty-eight (38) paintings of the plaintiff were totally destroyed thereby.

SIXTH:  Upon information and belief, that thereafter defendant collected and received from the insurance company with
