Sect. 11 of an Act of Congress approved July 17, 1862 provides that an Officer must be brought to trial within forty eight days from the date of his arrest.

That time having expired in your case you are hereby released from arrest.  You will remain in this City, and after selecting your place of residence will report the same to this office.

You returned the Monthly Report of this Command for June with certain directions for its correction and closed the endorsement with the remark that "This carelessness and disregard of instructions cannot be tolerated any longer".

I have been in the Adjt Genl Dept. for four and a half years and I never yet accounted for the losses and gains on the Monthly Return by marginal remarks.  It was never required by any Division, Corps, or Army Head Quarters that I have reported to, nor is is required by notes on the blank returns.  The report of losses and gains being placed on the Tri Monthly return has always been considered sufficient for reference.  I was not aware that you required it and had no means of knowing it this having been the first made.

You promised to send a copy of your last Monthly for the Dept of Ala. but failed to do so.  Had a complete copy of that been sent the remarks required by you would have been made on our return.

We had nothing to guide us but the manner in which we had been accustomed to make such a report.

The Tri Monthly Report was returned for a statement of the duty performed by men on "Extra Special and Daily Duty".  

The copy of your last Tri Monthly for the Dept of Ala that you sent us simply contained the figures on the face of the Report.

Our Report was made in the usual manner being guided by the Notes on the return, in the absence of any special instructions from you
