A A A G Macon Ga Major I have the honor to forward herewith the Monthly Report of this command for the Month of July 1866 Very Respectfully Your Obedient Servant Wager Swayne Maj General. Head Quarters Sub Dist of Alabama Montgomery Aug 29, 1866 /179 Whipple Bvt Brig Genl. Wm. D A.A.G. Nashville Tenn. General Permit me to correct an apparent error in your Roster of General Officers. In General Orders No. 1. Dept of the Tenn. (CS) the Command of this Sub District is assigned to "Brevet Major General Wager Swayne". In fact I hold a Commission as Major General, issued May 1st 1866 to Rank as such from June 21, 1865 I did not write you at once because it is a small matter, and I expected to go immediately out of service. But an order of Muster out that I had received, to take efect September first, the Secretary has for some reason but known to himself suspended till further orders, so that I am liable to a repetition of what puts me in a false position with whoever has understood from me that I held different Rank. I wrote you what I learned in Washington as you requested. Your Obedient Servant Wager Swayne Maj General Head Quarters District of Alabama Montgomery August 28, 1866 Semmes Raphael Esq Mobile Ala Colonel In reply to your note of the 26th I have to say, that the order some time since communicated to you directing me to interfere in the event of your attempting to exercise the functions of Civil office is still unrevoked. That order being explicit, I see no occasion for applying as you suggest, for additional instructions in the premises. To relieve you however, from the uncertainty you express as to the effect of the recent peace proclamation of the President, and of the "changed circumstances of the times" your attention is drawn to the fact that the order above cited points to the arrest, not so much of the Probate Judge of Mobile County as to an individual who for acts defined by the laws for the punishment of treason and for other acts liable at any time to be taken into custody.
