With considerable chagrin I have to report the discovery of a second instance of fraud upon the Government by an officer on duty in this District.  I have arrested and placed in confinement Bvt. Major R Theune, Capt. Vet. Res. Corp. for fraudulent disposition of Subsistence stores.

As in the former instance this prisoner will plead guilty but it will required some days to prepare specifications showing the amount of fraud.  Meanwhile I have to request that a Court Martial be immediately convened, that justice may in this case be prompt and summary.  It is probable that his Clerk also will be for trial, by the same Court.

I have the honor to transmit to you herewith the regulations and form of affidavit prepared in pursuance of your letter of 29 Ultimo, and to report that upon receiving it, having no officer who could properly be sent, as therein directed, I at once made application at the Headquarters of Major Genl. Thomas for the detail of an experience Commissary of Subsistence for that purpose.  I am advised in reply, that no Officer of the Subsistence Department can be spared, but that Capt I W Marshal A.Q.M and Bvt Maj. U.S. Vols is recommended for the duty named, and will be assigned to me if desired.  I have telegraphed, to ask that he be immediately sent here.  Upon his arrival instructions will be given him in detail, and a copy transmitted for your information.  Meanwhile, the within regulations and order have been prepared, and will it is hoped, meet your approval.  They are upon the basis of my letter of September 14th, and embody the results of our experience.  You will observe that while the Bureau, having at no time the custody of the supplies, is relieved from any imputations the checks are yet complete, and under our contract.
