On Monday, June 17" 67, between the hours of four and five o'clock P.M. I having business of importance to transact out of Dauphin Street, I entered a car on Josephine No 2. I was immediately ordered out by the conductor, and he said to me that outside was my place, and that I could not ride in the car. I came off the car, and I James B. Gibbs do enter suit against the said Dauphin Street Car for infringing upon my right according to the Civil Rights Bill.

I then appealed to Justice of the Peace J.T. Cane, and he refuses me of entering suit against the said party, and said we had no right to enter suit through him on said parties.
(Signed) James B. Gibbs

The within statement was sworn to and subscribed before me by James B. Gibbs the 18" day of June 1867.

One Monday June 17" 67 between the hours of four and five o'clock P.M. I had business of importance in the upper part of the city. It got on the Dauphin St Car No 2 between St Joseph & Conception Sts. I was ordered to leave the car by the Conductor whose name I did not learn thus being deprived of the right to ride on a public carriage. I have been the loser in my business relations. I therefore wish to enter suit against the said Dauphin Street Car Company to indemnify me in the loss I sustained by being denied the exercise of a civil right.

Sir

Complaint has been made at this office that you have refused to comply with the terms of a contract made by you with Solomon Whetstone, and other freedmen, on the ground of their having attempted to register themselves as voters under the late act of Congress entitled "An Act to provide for the more efficient government of the rebel states", and the Act supplementary thereto. The Assistant Commissioner directs me to call your attention to the fact that such conduct is strictly prohibited, and to notify you that persistence therein will result in your appearance at this officer under process. A copy of Extracts 12 and 13, General Orders No 20, Head Quarters Third Military District, current series, is enclosed for your information and guidance.

Very Respectfully
Your Obd't Serv't.
