new trial it is not deemed necessary that an Order should be issued.  By mutual consent of yourself and Mr Harris a new trial can before any Justice or Justices you may punctually choose and the testimony admitted which was before thrown out.  Mr. Harris of course has a right to appeal from any decision to a higher court.  In all cases where papers are referred to you for report they must all returned.  You will therefore at once return the communication of Mr. Harris.
