Commissioner Eufaula, Alabama. Sir Yours of the 8th inst to Judge Smith asking as to the rights of a husband in contracting the service of his wife has been referred to this Office. In reply I have to say that the husband and wife are in such matters simply on an equality. The husband cannot contract his wife's service or the wife her husbands. If such contract is made by the husband with the consent of the wife it is then the same as her own individual contract for the fulfillment of which she alone is responsible. "Total Well" should be 38 instead of 34 - also aggregate of First Class should be 76 instead of 64. It is presumed that the errors occur through counting each child as one half. This is incorrect.
