returned with the information that nine men were released from custody on the 31st ult under bail, to appear when called for.

The statement of Mr. McKinne that I would not release the men is the absence of Genl. Swayne is incorrect. I retained them in confinement until I could ascertain when they could be tried for their offense.

Respectfully returned with information that the horse was transferred to me in January last by Capt. J. Rit Boyle, A.Q.M. and I have since then transferred him to Lt Downard A.Q.M. at Selma, Ala. 
I presume the horse was seized by Capt Boyle A.Q.M. in obedience to Gen Order No 61 C.Q.M.O. & a copy of which is enclosed.
