Mobile Ala March 18 1868 Respectfully returned to Asst Comms Ala with enclosed letter of Messrs Manning and Walker Atts for Messrs Buck and Fuller and statements of Sheriff of Mobile Co. and Clerk of City Court showing that the proceeds of the 27 Bales are still in the hands of Messrs Buck & Fuller and are the subject of garnishment process in a suit commenced by Messrs Smith and Roberts against Dubbin and Roberts. The case will not come before the Court for a week or ten days. It strikes me from an examination of the Reports furnished that the contestants in the suit before the city Court are litigating over what does not belong to them. That the proceeds of the cotton should be distributed among the laborers who made it who have not been paid. Ordering legal process under GO 13 & 14 establishing Agricultural lien might suffice if the plantation were in this District but as the case now stands I do not know of any process by which the money may be secured to the laborers except by Military seizure. The transfer of the Cotton to Longstreet with the approval of Genl Ord would seem to render any interference on the part of the Asst Commr for Ala highly improper because of the understanding which was once had with Longstreet in which Longstreet was to settle with the Freedmen. It does not appear that any effort has been made to obtain a settlement in that direction, and therefore there is nothing to warrant a seizure of the Cotton as desired. J. Hayden Bvt Maj Genl U.S.A.
