Enclosing copy letter of 16th inst explaining why the exchange of transportation was made without reference to the Commr. as required by orders A careful personal examination into her circumstances was made and she was found to have no money friends or acquaintances and had two small children in charge It was believed that as the Commr had issued her transportation that upon application he would have ordered the exchange as made by the Asst Commr Had she remained at Montgomery awaiting the return of the application she would have been a charge to the Government To avoid this the exchange of Transportation was made believing that it would meet the approval of the Commr. Application was made for the appointment of Mr Gale as Agent, which was returned stating that an officer would be asked for the vacancy. Mr Claus, the former Agent at that place, (Greensboro Ala) had been assaulted and compelled, he thought, to leave, and the need of an Agent there induced Lieut Bennett to employ Mr Gale for the position, which action was approved by the Asst Commissioner. There has been no Officer to assign to the place. I would therefore most respectfully request that he be appointed Agent at a salary of One Hundred Dollars per month to date Febr 17, 1868, or that authority be given for payment for his services rendered up to May 1, 1868. The order from the Sub Asst Com'r is quite unusual and is deemed unjust inasmuch as it assesses and orders an amount paid giving no opportunity for the party to disprove the claim before him. If the complainant is heard, defendant should be heard also.
