Gen Swayne

Dear Sir,
As Judge of Probate of this County I accept your proposition contained in order No. 7, to delegate the authority to Civil officers to try cases between negroes and negroes and between negroes and whites &c, on the condition they permit the evidence of negroes &c,

I should have sent in this acceptance sooner but have been sick for several weeks and unable to attend to any business and have not fully recovered yet, I will visit Montgomery as soon as I get able when I hope to see you and get full instructions.

There are but few negroes comparatively in our precinct and I suppose I will have but little business of that kind to attend to. I suppose the Justices of the peace will attend to the business in their respective precincts as in cases between white persons.

Very Respectfully
Your Most Obt Svt,
G W Benson
Judge Probate
