LEASE FOR HOUSES AND TENEMENTS ONLY

Memorandum of an Agreement made this 9th day September 
1865, between T.M. Goodfellow, chap 101st U S C I and Supt R.F & A.L Sub Dist Huntsville Ala.
[[strikethrough]] Special Agent of the Treasury Department [[/strikethrough]], duly appointed under the Acts of Congress respectively approved March 12, 1863, 
and July 2,1864, for taking charge of captured and abandoned property, and leasing abandoned property and confiscable lands, houses, and tenements in the First [[strikethrough]] Agency [[/strikethrough]]  Supt, and Geo. P Beirne of Huntsville in the County of Madison and State of Alabama.

WITNESSETH, that in pursuance of said Acts, and of the instructions of the Secretary of the Treasury, the said Agent, for and in behalf of the United States, agrees, upon the terms hereinafter contained, to lease to the said Gen. P Beirne from the 10th day of July 1865 from month to month, either party hereto being at liberty to terminate this lease at the end of any month from the date hereof, the following described premises: The two story brick dwelling House situated in the city of Huntsville Ala. on the South side of William St. between Franklin St. and Adams Avenue, together with all the grounds out buildings and other appurtenances thereunto belonging being the property of one Geo. P. Beirne and seized under the provision of Por II Rules & Reg. Secty. Treasry. concerning abandoned and confiscable Lands, Houses and Tenements.

And the said Geo P. Beirne hereby agrees to pay the said Supt [[strikethrough]] Agent [[/strikethrough]] Fifty (50) dollars per month, for each month from the date hereof, so long as he shall continue in possession of the said premises, and to pay the rent of each month in advance, and at the expiration of this lease as aforesaid to deliver possession of the said property to the said Agent, or his successor, in as good condition as the same is now in, loss by fire of other unavoidable injury excepted.

The said Beirne executes this lease under protest contending that the property in question has never been abandoned by him and the government has not the right to require a lease and rent from him for the occupancy of his own property.
