J. J. Giers (vs) James Gouch

1. Mr. Giers must recover the corn in this case, if the Tribunal have jurisdiction. The only witness who contradicts the statement of Mr. Giers, & the case the testimony makes for him, is Mr. Gouch, the elder. And his testimony is flatly contradicted by the appointment of agency, handed by him to James Gouch, & produced on the trial by the Defendant James G. Gouch the elder declares, that Giers gave him up his lands, stock, provision, tools, houses, furniture & every thing he possessed, and that he (Gouch Sr) was to have all that he could make from the same for two years. And that he (Gouch Sr) was not to pay him a cent for the same, & was not bound in any manner to support or aid in the support of Gier's family, in the mean time. His testimony represents Geirs as abandoning of his family to the could charities of the world, during his refugeeing, & possessing Gouch Sr of all that he (Giers) owned to be used for the sole benefit of Gouch, without
