Mobile November 6th 1865

General

At a meeting of the Board of Trustees of the Mobile Med. College called to take into consideration the condition of the college and to act upon your proposition to lease the same made to Dr J. C Nott and by him submitted to the Board, I was instructed to say that the building is not for rent on any terms; that it would be a violation of the trust reposed in us, for as to do so, and that the Board respectfully declines accepting your proposition. I respectfully invite your attention to the following facts, in their connexion:

The building in question was constructed, and the land on which it is erected was acquired by the Board for "the purpose of the Mobile Medical College" in pursuance of an act of the legislature incorporating that much further. This act expressly provides that the property acquired by this fund shall be held solely and exclusively in trust for the use and benefit of med college. The trust could not be more specific, nor expressed in clearer language. By the same act the college was made a department of the University of Ala
