Charge Vagrancy, preferred paragraph 4. Genl Order No 12. issued August 30th 1865. Head Qrts Asst Commissioner Bureau of Refugees &c Montgomery Ala.
W. C. Penick on part of the state introduced and proved the due execution by the parties thereto the writing hereto attached marked exhibit (A) as well as the approval of the same by C. W. Buckley Asst Supt of Freedmen &c, that it was executed the day it bears date having been read four times to the defendant, That Asberry in accordance with said contract went to work for W. C. Penick and continued with him untill about twelve days since, when he abandoned said contract & left the premises of the said Penick without any real or pretended excuse, and after being warned not to do so by said Penick, and that he has not yet returned to his labor or offered to do so.
Defendant then introduced the paper hereto attached marked exhibit (B).
