any of the exceptions to the Proclamation of May 29th 1865, but that he was advised by some of his friends to apply for Pardon under the tenth clause of said Proclamation, which reads as follows -
"10. All persons who left their homes within the jurisdiction and protection of the United States and passed beyond the Federal Military bases into the pretended Confederate States for the purpose of aiding the rebellion" that as he had left his home he did apply for Pardon. Contrary to his own judgement having left the County under the stat of facts set out in his application for the restoration of his property that in addition to said statement, he now states that he was, clerk of the circuit court of Madison County, at the time he left Huntsville and been for twelve years - that the Legislature of Alabama by enactment required the Clerks of the Several Courts to remove the records upon the approach of the Federal troops - that he did so remove his records, and having no business in the County without the records he left to engage in business as stated in his said application - that at the time he left Huntsville the place was occupied by Confederate troops and Genl Bragg was holding a large part of Tennessee. hence he says he did not leave the Federal lines, nor did he pass into the pretend [[illegible]] as he did [[illegible]] crossed [[illegible]] in the [[illegible]]
