Tombigbee River. The "Heroine" the smallest of the four that were surrendered, was so delivered.

It was a capture by the land forces of the United States, and I do not see how it can come under the jurisdiction of any Court, except ultimately of the Court of Claims, if the claimant can show to the satisfaction of that Court, that they have a right to the proceeds - that they were loyal to the United States, and that they have never given aid and
comfort to the enemy during the Rebellion.
Even if they were private property, they were still subject to capture; and that right was expressly reserved in the case of these vessels, by the joint order issued by Admiral Thatcher and myself.
