satisfied no fair minded person can think it just, that a person conducting a business which had been always lawful, should be punished for continuing such business, in the absence, not only on his part, but of all the community, [[strikethrough]] that [[/strikethrough]]
of the knowledge of the restriction thrown around it. Cutler is a poor man, and, whilst he is industrious and proved an excellent character to the Court, he will feel heavily the burden imposed on him to meet the amount he is required to pay on the execution issued from the Judgement referred to.

Knowing that his Excellency is disposed to do justice to every person in the State I hope and believe that he will interpose the powers conferred on him to relieve Cutler from such unjust punishment, and I submit this statement to you, that you may intercede with Gov Patton, as I am convinced you will. I send herewith the statement of Geo G Lyon and W E Clarke, who were the Attys of Cutler in said case, verifying the statement herein made. I understand they are known to Gov P- but if he requires additional evidence I can furnish it.
