Tu Co. Ala  Sept 20th 1866 

Sir This F.M. Sam Lucious was shot on the 31st of Aug 1866 at Pinkney Philips Still house or near there. I prossicuted Mr Philips. This trial come off on Sept 8th  before A.H. Gealy J.P. The witnesses was William Browning, Robt Browning and William G. Abernathy. The Browning's swore that he Pinkney Philips did order Sam to leave, they say they tried to get him (Sam) to leave. But he still lingered till Philips went about fifty yards and got his gun and shot Sam.  They did not prove anything that Sam had done only he would not leave when he was told. Abernathy says Philips treated the [[strikethrough]] negroes [[/strikethrough]] F.M. with whisky and and when the crowd come up he looked over them and said the right one had not yet come (Sam still behind), he further said there was one he wanted to Ketch and when Sam come he got his gun and shot him.  The jury men wich was Thos. Lucious, J.A. Stewart, James Cook Messer Brook Simp Gregory and James P. Inlizby found the accused Pinkney Philips not guilty.  Sam was on his way from the land farm as I had just dismissed the hand's consequently Sam not being willing to pay the cost.  Also I learn from a Lawyer that there
