In refference to the case I was speaking to you about in the Govrs office this morning it is this a Mr. Smelser joined the Federal army some time before the close of the late War. & was regularly Sworn in the Service, he was acting as captain of a company of Scouts - when he was captured, with a portion of his men by a Capt Johnson of the Confederate Army - Smelcer was Hung & the rest of his men shot.  his widow lives near me, in Marshall Co Ala & I having been acting as agent for R F & A L in my county
