Contract was by its terms "was to be performed within one year from the making thereof"

Therefore I beg that I may be permitted to ask a reconsideration if that part of your ruling which says that, "A contract executed in writing takes precedence if a [[?]] contract unless the first mentioned contract is made under false pretences [[pretenses]],"

Again, if the statement of Brister to me is to be credited, that the express [[strikethrough]] term [[/strikethrough]] terms and conditions upon which he entered into the engagement with Mr. Gutherie was, that Mr. G. would certainly rent my plantation for the year 1866, then the Contract, as far as Mr. Gutherie was concerned, was "made under false pretences [[pretenses]]."
 
I must beg you Sir, not to believe that the solicitude and persistency, with which I am endeavoring to enforce my views; result entirely from feeling.  Such is not the fact.  I have feeling in this matter yet I am controlled by a solemn promise
