Maj. O.D Kinsman

Dr. Sir:-
I herewith return the papers forwarded in the case of "Moses" - alias Moses Case - who has complained of injustice done him by the Probate Court in apprenticing two of his children to one Wm M. McBryde of this county.

Agreeably to the request of General Swayne I have instituted proper proceedings for the ascertainment of the facts in the case - and, herewith transmit to you the decision of said Court. Also, the proof taken in said case-

1st. - The court decides that on the 26th day of Decr. 1865 that the Father & mother were Not by law required to have notice of the binding out of indigent children - this being the date of Indentures-

2nd - That from his own knowledge and the proof submitted Mr McBryde is a proper person to have charge of such children-

3rd - That no injustice has been done to either parent or children - because he says that said Moses & wife cannot possibly support their children according to the proof- That they do not provide for one already in the care of Mr. McBryde - over whom he exercises no control - (a little girl 5 years of age)- That said Mose has no good character for honesty &c in the country - likewise his wife steals - Therefore, they ought not to seek to have set aside the proceeding in the premises.

concurring fully in the Judgmt of the court - having a personal knowledge of Many of the facts - I beg leave to return the papers-

Your obdt Servant
