Moore and in his presence. That Capt Horner assessed the fine for obeying Col Moore's orders after Col Moore had left them temporarily on a trip to Mobile. That Col Moore on his return remitted the fine, declared it void and ordered Capt Horner to deliver up the note which he refused to do. That it was only after Col Moore had left that Capt Horner again enforced the collection of this same note, given as stated in our communication.
Should it be the pleasure and order of the General Commdg District of Alabama to direct any one to investigate this matter here. Mr Drake respectfully requests that 
he will direct the testimony to be taken in writing, so that the whole matter may be finally reviewed by him on all of the facts as elicited under oath.
In Mr Drake's name he respectfully state, that he does not desire in any way to infringe any order, directive or command of the Military authorities or to violate their spirit. In this  matter he contends that he has been wronged, directly against the order
