Personally appeared before me Wm. M. Loundis a Justice of the Peace for the county and state aforesaid.  Moses Davis who being sworn says, that he called on Judge Bayley of Chetain County, Alabama,  and handed him  Genl Wager Swayne's order commanding said Bayley to deliver to said Davis one John Bell the son of said Davis. That Judge Bayley read said orders of said Swayin and replied to said Davis that he had bound out said John Bell and could deliver said Bell to said Davis but under the circumstances he would not do so. That if said Davis had applied to him in a legal manner as the Probate Judge of Choctaw Country he (Bayley) could have delivered said Bell to said Davis, but he could not recognize the order of Genl Swayne as binding on him in his official capacity. And that if he Davis would employ a Lawyer and proceed legally in the matter he Bayley would deliver the
