We are inclined to agree with his Honor in what he said in your presence as to the matter of your appealing- It would present the anomaly substantially of the Government appealing against itself. It seems however to us that there should be some way of testing the Judge's decision in the Supreme Court. That court, must in the nature of our judicial system have a general supervision & control over inferior tribunals, and it is possible that this matter might be brought before it on an application for a prohibition to the superior court against making the sale. If effect is to be given to the law the court is without jurisdiction to order a sale, and courts may be prohibited from proceeding when acting without jurisdiction we simply throw this our en papant as a suggestion for what it is worth.
