articles as she desired to remove to pass through the Federal lines - But the said Hawkins instead of procuring a safe transit for Petitioners family actually gave notice to the Rebel Pickets of the intention of Petitioners family to pass the lines - The family of Petitioner supposing it was all right to pass through - and the Rebel Pickets seized and took, horse, wagons & household furniture, in fact nearly every thing Petitioners family had along and confiscated or appropriated same to their own use - forever depriving Petitioner of the same - Your Petitioner never took possession of the 800 acre tract of Hawkins - And so soon as the War closed your Petitioner returned to the County of DeKalb & proposed to rescind the trade &c. Finally it was agreed between said Hawkins & Petitioner to refer their matters in controversy to the Arbitrament of Messrs Beeson, Hammock, Roberts, Franklin & Driskill - all of which will more fully appear by reference to Exhibit "A" hereto appended which sets forth the submission, award & the Proceedings had thereon in the Circuit Court of DeKalb Co. Ala. - Your Petitioner was willing to abide by the award of the Arbitrators & so stated, was then & is now ready to comply in every respect - but said
