Maj Genl Wager Swayne
Montgomery, Ala

Sir
Since writing to you on yesterday (Saturday evening) I resumed the investigation of the case of Lewis Curlee vs J.M. Speer, as the Attorney for Curlee, I stated in my last communication to you that Thomas Williams Atty for the defence in his opening remarks on Friday morning stated that in getting up the petition to you for this case to be investigated by Military Authorities, had brought a reproach upon the people of Elmore County–that it was as much as [[strikethrough]] that [[/strikethrough]] to say the world what the civil tribunals of Elmore County were so prejudiced against the negro that he could not get justice. Then infering that I as the atty for the negro Curlee for making the petition and you for granting it had brought a reproach upon the people. These remarks had the effect for which no doubt they were intended To inflame and prejudice the community against me for having done what I believe conscientiously to be my duty as an honest man [[strikethrough]] to do [[/strikethrough]] it takes but little to inflame those passions, for I tell you as a candid man that the spirit of Rebelion burns with as much intensity to day
