of the warrants and the endorsements, I obtain from the original warrants themselves. I was desirious of seeing Mr. Lavender and Ben, or Mr. Kilgore, that I might better enable myself to report to you, and if warranted, to have the case prosecuted in Lowndes County, where the offence, if any, was committed. Accordingly I addressed a letter to Mr. Lavender, a copy of which I herewith enclose. Mr. Lavender received my letter, but he has neither come to see me, nor replied to my letter, nor has Mr. Kilgore or Ben come. Therefore, and since Ben and Eliza are no longer detained, nor molested, I infer Mr. Lavender has abandoned the further prosecution of the case. Assuming this to be true, I have thought it fitting to make the above report, and, if it be satisfactory to you, to let the matter rest until, at least, Mr. Lavender, or some one else make the proper affidavits to warrant a Judicial investigation.  Should there be a Judicial investigation, it will have to be made in Lowndes County, where the offence is alledged to have been committed.  Lowndes County is not in my circuit, but in the second judicial circuit, of which Mr. Elmore Fitzpatrick is Solicitor. He resides in the city of Montgomery. The case could be entrusted to the prosecuting attorney of the County Court of Lowndes County.
