Robt Evans witness for defendant states that Mr Grant hired the freedman Leven Colvin to work for him the year 1866 and then hired him to Dr G.A. Tompkins for one month at ten dollars per month after which time said Leven went to work with said witness for said Grant further states that the freedman Leven worked very well while in the field, but would quit occasionally of Saturday evenings without permission The witness further says that he told Leven that they must get to work sooner and stay later or they could not make a crop here. Leven replied that he had to cut wood for Mr Grant that was the reason for not getting to work sooner Also complained to Mr Grant about having to cut wood for him and got mad and quit and went off and staid one or two days then returned and beg leaf to remain and make the crop and that he would behave himself obey orders &c and said Levan then staid until the 10th or thereabouts of August 1866 further states that Leven said he had staid as long as he agreed to stay and that he was gong to Mr McLaurines to ditch that he could make more at that than anything else he could go at. also said he didnt want to stay after Mr Grant had left there, the witness states further that he went to the field all the time before Leven did with the exception of 3 or 4 times and that he worked several Saturday evenings when Leven did not The witness supposes the caus for him being late a bout getting out to work of a morning was on account of
