Sir the petition of Gus Giddins Respectfully herewith that heretofore (To wit, in the fall of last year One Benjamin Palmer accused your petitioner of having one tree cut of his land by one Charles Iverson Col. your petitioner [[?]] to the charge whereupon he carried the cause to the County Court where Deft was fined ten dols and costs. Petitioner further states that he was advised by his council Jon N Phillips to appeal to the Circuit Court,

The cause when it came up Pltf moved to continue, without the he could obtain the testimony of one Chas Iverson whereupon deft's atty being present and without consent of Deft  admitted to the Jury that if known was there he would swear to the facts as charged in the indictment.  when the Jury retired and returned a verdict for Pltf & fine of Fifty dollars and costs. and now moves the sheriff to collect the same.  Contrary to truth and good conscience your petitioner further exhibits the Testomony of said Charles Iverson Taken before U. L. Martin a Justice of the peace which accompanies this petition and your petitioner will ever pray &c
