To Capt J. F. McGogy- Commanding Sub
District of Talladega, Alabama.

In obediance to orders and instructions to me directed hereto attached, I as Judge of the Probate Court in and for the County of St. Clair and State of Alabama, have the honor respectfully to submit the following. Report of my action in the previous to wit. That immediately after the reception of said orders and instructions I summoned Thomas J. Moody to be and appear before me at my office in Ashville Alabama, on Monday the 29th day of July 1867, and that in obedience to said summons said Moody appeared before me at said time and place, and stated that he had received a copy of said summons, but had been notified by a friend probably his father to appear, that a copy of said summons had been kept by the Sheriff of said County with some one of his neighbors for him, and that in consequence of failure he the said Moody did not know previously what he would be required to report to you. Said Thos J. Moody by way of report made and filed an affidavit in my office [[strikethrough]] the following [[/strikethrough]] of which the following is a copy--

"Before me Jno W Inger, Judge of the Probate Court in and for the County of St. Clair and State of Alabama, on this 29 day of July 1867, in obediance to a Summons, personally came Thomas J.
