The Def't then read in evidence the order of the President dated 11" Nov 1865, which is as follows:
Washington. City Nov 11th 1865.

Ordered:
That the Civil and military Agents of the Government transfer to the Assistant Commissioner of the Bureau of Refugees, Freedmen and Abandoned Lands for Alabama the use and custody of all real estate buildings or other property belonging to the late Rebel Government together with such funds as may arise or have arisen from the rents, sale, or disposition of such property which has not been finally paid into the Treasury of the United States.

He then introduced proof tending to show that Col. Robinson was Superintendent of the Freedmen's Bureau and Capt. Kerr was under his command, and that said boat was seized by Kerr as public property and sold as such to Deft.
