Charge 2d-Neglect of duty.

Specification 1st-In this, that Brevet Major James Curtis, Captain 15th U.S Infantry, being in command at Fort Gaines, Ala., did permit a quantity of iron and other property, to-wit, and about fifteen (15) tons of railroad iron, five (5) tons of scrap iron, and one (1) steam boiler, the property of the United States, to be taken away from the limits of his command to be improperly disposed of, or did permit the same to be improperly disposed of at Fort Gaines, Ala. This is at Fort Gaines, Ala., on or about the 10th day of July 1866.

Specification 2d-In this, that Brevet Major James Curtis, Captain of 15th U.S. Infantry, being in command at Fort Gaines, Ala., did permit one boat, the property of the United States, after the said boat had been repaired at Fort Gaines Ala., to be taken away from the limits of his command to be improperly disposed of by private parties for private benefit. This is at Fort Gaines, Ala., 
on or about the 12th day of October, 1866.

Specification 3d-In this, that Brevet Major James Curtis, Captain 15th U.S Infantry, being in command at Fort Gaines, Ala., did permit three (3) pile hammers, the property of the United States, to be taken away from the limits of his command, to be improperly disposed of by private parties for private benefit. This is at Fort Gaines, Ala., on or about the 20th day of October, 1866.

Specification 4th-In this, that Brevet Major James Curtis, Captain 15th U.S Infantry, being in command at Fort Gaines, Ala., did permit a sum of money amounting to about thirty-six dollars ($36), said to have been in the proceeds of the sale of a quantity of iron, which iron was the property of the United States, to-wit, about five (5) tons of scrap iron and one (1) steam boiler, to be misapplied by being turned over to companies stationed at Fort Gaines, Ala., as company funds. This is at Fort Gaines, Ala., on or about the 10th day of July, 1866.

To which charges and specifications the prisoner pleaded as follows:
