Charge 1st-Misapplication of public property, with intent to defraud the United States.

Specification 1st-In this, that Brevet Captain William Galloway, 1st Lieut. 15th Infantry, being on duty at Fort Gaines, Ala., as Acting Assistant Quartermaster, did take the possession of a boat, the property of the United States, or which had been captured from or abandoned by the late rebel government, or had drifted to shore within the limits of Fort Gaines, Ala., which boat he, Brevet Captain William Galloway, 1st Lieut. 15th Infantry, A.A. Q.M., did cause to be repaired and put in order at the expense of the United States, or partially at the expense of the United States, and after having so repaired and put in order the said boat, the said Brevet Captain William Galloway, 1st Lieut. 15th Infantry, after having been relieved as Acting Assistant Quartermaster, did proceed to sell, barter or dispose of, or cause to be sold, bartered or disposed of, for the sum of seventy-five dollars ($75), or about that sum, to Mr. Metzgan, of Mobile, Ala., and did appropriate the proceeds thereof to his own private use and benefit. This at Mobile, Ala., on or about the 10th day of October, 1866.

Specification 2d-In this, that Brevet Captain William Galloway, 1st Lieut. 15th U.S. Infantry, being on duty at, and in temporary command of Fort Gaines, Ala., did order 2d Lieut. William P. Schall, 15th Infantry, A. A. Q. M. at Fort Gaines, Ala., to take three (3) pile hammers, the property of the United States, to the pier at Fort Gaines, Ala., for the purpose of shipping the said pile hammers to Mobile, Ala., for his, Brevet Captain William Galloway's, 1st Lieut. 15th Infantry, own private use and benefit. This at Fort Gaines, Ala., on or about the 20th day of September, 1866.

Specification 3d-In this, that Brevet Captain William Galloway, 1st Lieut. 15th Infantry, did sell, barter, or dispose of, or cause to be sold, bartered, or disposed of, three pile hammers, the property of the United States, and did appropriate directly, or indirectly, the proceeds thereof to his own private use and benefit. This at Mobile, Ala., on or about the 10th day of September, 1866.

Charge 2d-Conduct unbecoming an officer and a gentleman.
